[A]   Global Economy and Australian Migration

The Australian Migration Regulations are a tool used by the Australian government to regulate the supply and demand of skilled work force in Australia.  They are therefore subject to changes in response to fluctuations of the economic climate in Australia.  The recent global economic downturn has adversely affected Australian Migration in that, generally speaking all types of migration to Australia have become more difficult compared to 2 to 3 years ago.  This is particularly evident in relation to General Skilled Migration in that apart from reduction in numbers, regulations have been introduced resulting in a much longer waiting time.  Applicants wanting to migrate under the General Skilled Migration Program should look at the Employer Nomination Scheme as a faster method in achieving their aim.


   About Employer Nomination

The Australian Employer Nomination Scheme allows applicants to work or migrate to Australia on a temporary or permanent basis, in either metropolitan or regional areas.  Different Subclasses in different areas have different regulations.  Generally speaking, the Australian Government is giving these applications faster attention because there are vacant positions available in Australia to be filled.

Employer Nomination Applications, whether they are temporary or permanent visas will take any time between 2 to 4 months to finalize.  This is of course a much faster way of securing a working or migration visa. 

Strangely enough, in an attempt to curb the 457 temporary applications, the Australian Government has introduced more stringent requirements for temporary resident visas compared with permanent resident applications.  This is an interesting anomaly which some people believe will be rectified sometime in the future. 
 

[C]   Difficulty Facing the Employers

Given the fact that it is easier to meet the requirements of permanent resident visas, it is logical that most employers would consider using this method to solve their staffing problems.  However, in order to sponsor a permanent resident visa under ENS, a contract of at least 3 years need to be signed.  This is a discouraging commitment for some employers as they do not have the opportunity to personally observe the skills, and the work attitude of the worker because it is quite impossible to assess these in the course of an interview.  The working relationship between the employer and the employee is often developed over a period of time when they have the opportunity to work under pressure and to deal with emergencies.  Most employers therefore are reluctant to appoint someone for 3 years without the benefit of a face to face interview, something which is difficult to organize for overseas applicants.  While there are still vacancies in Australia which cannot be readily filled by local applicants, employers are reluctant to look overseas for suitable candidates.   


[D]   Difficulty Facing the Applicants

 It is quite impracticable for overseas applicants to travel to Australia to be interviewed and to be skill assessed by prospective employers, because there is no guarantee that their interview will definitely lead to employment.  As a matter of fact, many applicants in a lot of countries do not have easy access to a Visitor’s Visa.  The application for a Visitor’s Visa can be a daunting task to a lot of overseas applicants, even if they have the financial resources and the time to be interviewed in Australia. 

On the part of the applicants, it would of course be ideal, if they could secure a job before they enter Australia.  For most qualified overseas applicants, it should not be too difficult to land on a suitable job in Australia after a period of time.  The difficulty is how they can secure a job upon arrival at the early stage of their working career in Australia.

 
[E]   Working Holiday Visa

The Working Holiday Visa (Subclass 417) is a scheme participated by a number of countries in the world to allow their citizens to travel and work in Australia.

There is a similar scheme called Work and Holiday Visa (Subclass 462) which carries more stringent requirements.  For the purpose of this paper we shall only deal with Subclass 417.

Australia is open to nationals of the following countries who meet certain requirements to come to visit and work in Australia.
A-F   G-L   M-Z
Belgium
Canada
Cyprus, Republic of
Denmark
Estonia
Finland
France   Germany
HKSAR*
Ireland, Republic of
Italy
Japan
Korea, Republic of   Malta
Netherlands
Norway
Sweden
Taiwan
United Kingdom


Nationals of the above countries may apply if they:
•   are aged 18 to 30
•   are in possession of adequate funds (over AUD 5,000);
•   can organize Private Health Cover; and
•   can pass a simple medical exam.
The fee for the Visa is AUD 230.  It will normally take one week to process if they apply online.  The Visa will normally carry the following conditions:
•   The validity is for 12 months;
•   A second Working Holiday Visa may be granted if they have performed qualifying work in the regional area for over 3 months;
•   They are allowed to work for more than one employer but each employer for a maximum of 6 months; and
•   They may apply for other types of visas if they are qualified.

It has to be stressed that the spirit of the Working Holiday Visa is to allow young people from participating countries to travel extensively in Australia but providing them with the opportunity to work to supplement their travelling expenses.  As a general rule, the department does not encourage applicant to use this visa in place of a proper work visa.


[F]   Wouldn't it be Lovely?

Despite the caution comment given above, applicants can legally utilize the Working Holiday Visa to overcome the difficulties facing the employers and the applicants as described in the previous sections.  Here is a possible scenario:

•   The applicant applies to the employer prior to his arrival in Australia;
•   The employer conducts the necessary recruitment formalities, including telephone interview or video conferencing;
•   The employer offers a position to the employee for a period of 3 to 6 months;
•   The employer has the prerogative to terminate the appointment if the employee is subsequently found unsuitable for the position;
•   Because the Working Holiday Visa only allows the visa holder to work for each employer for up to a maximum of 6 months, the applicant will need to apply for a suitable visa, such as an 457 temporary resident visa which allows him to work for a period up to 4 years, or a permanent resident visa after arrival in Australia; and
•   In order to apply for an 457 visa or a permanent resident visa (such as an 856 or 857) the applicant will have to have a positive assessment of his qualifications. 

There are advantages for both employer and applicant in the above scenario.  For the employer:

•   He is only committing himself to a short employment of 3 to 6 months;
•   He makes the above decision after appropriate screening, including telephone interview or video conferencing;
•   He gets his worker in just a few weeks’ time;
•   He has ample opportunity to personally observe the performance of the applicant;
•   He has the prerogative to terminate the appointment if the applicant are found unsuitable for the position, including when their chemistry does not work out; and
•   If he finds the employee can perform, he can then offer to sponsor the employee for either a temporary or permanent resident visa.

For the part of the employee the scenario is also advantageous because:

•   He  departs for Australia with a job waiting;
•   If he fails to meet the requirements of the employer and is later given the boot he has the advantage of having physically worked in Australia and he would be in much better position to look for alternate work and sponsorship;
•   If his performance meets the requirement of the employer, he will be sponsored for either a  temporary or permanent resident visa; and
•   If there is a need for his qualification to be assessed, opportunities are readily available in Australia for the assessing authorities to conduct the assessment.

To conclude, it would be really lovely if the event described in the above scenario could be achieved, because it is a win-win situation for both the employer and the employee.


[G]   What is the Catch?

If we analyze the above scenario we will notice that both the employer and the employee would require some third parties to step in to organize the whole exercise.  Assistance in the following areas is required:

•   A placement agency is required to marry the two parties for the position;
•   Someone will have to assist with the qualification assessment ;  and
•   A migration agent will be required to assist with the Working Holiday Visa application and the subsequent temporary or permanent resident visa application.

The employee must have mental preparation that he has to pay for the above professionals to pave the way for his eventual migration to Australia.
 

[H]   Do You Need Help?

Although the above scenario has focused on candidates qualified to apply for the Working Holiday Visa, applicants from other parts of the world or who are over 30, are also welcome to approach us as we may be able to help.
